In short, the authority asks the court to review the contract, declare the lease void and permit the authority to repossess the land on which [ANDRETTI-THAYER] has parked a construction trailer. The authority also claims damages arising from Andretti-Thayer's failure to complete the fixed-base facility by Dec. 10, 1988, and to pay land rentals totaling $4,940 since Dec. 10.

Because of varying legal interpretations of when the lease was technically breached, solicitor William Cassebaum advised the authority that Andretti- Thayer had 60 days to remedy problems with lease compliance. In the opinion of the solicitor and airport administration, the remedies were not forthcoming this week.

Airport Director Jack Yohe declined yesterday to elaborate on the three counts in the suit. But, in response to questions from the news media, Yohe said that Andretti-Thayer had failed to pay 5 percent of the matching grant money or $50,000 of the applicant's share. Although the firm had paid some initial engineering costs, Yohe said the authority had incurred extra engineering costs for the project that total as much as $100,000.
