Abstract (Document Summary)

Capt. Ofer Reshef of Haifa, Staff Sgt. Eli Shukrun of Jaffa, and Sgt. Gadi Zinba of Ashkelon, were charged with assault, rather than murder, because [Ayad Akal]'s body was spirited away from Shifa for burial before an official investigation could be conducted to determine the exact cause of death. The battalion commander, Maj. Yitzhak Levite of Jerusalem, was charged with sanctioning the beatings.

Among the high-ranking officers on whom the judges cast suspicion of improper conduct were Col. Ephraim Fein, then O/C Givati Brigade, and Brig.-Gen. Ya'akov Or, then IDF commander in the Gaza Strip. The court also said that then O/C Southern Command Maj. -Gen. Yitzhak Mordechai had ignored the fact that soldiers under his command beat Arabs to punish them.

"I am not sorry for the orders I gave; they accurately reflected the orders of my superiors," he said. "I have nothing against Gen. Yitzhak Mordechai, who gave us orders to use force. All the brigade commanders from the Gaza Strip testified that those were his orders. It hurts me that Col. Fein and was the only one who testified differently."
