The trademarks that once existed were lost as the product type became more widely recognized and used than the product's brand and essentially became synonymous with the product and not its producer. When the trademark of a product is no longer recognized as being distinct from the product itself, trademark protection can be lost in a process known as genericizing or trademark erosion. Trademark erosion is one of the classic catch-22s of trademark law, in that it indicates such a complete success of the brand representing the product that the brand becomes the product and is no longer recognized separately as a brand.
